Having written about Dr Pepper's infamous Guns N' Roses promotion before, we should come full circle with the latest about it. As you've surely heard, GNR has filed a lawsuit demanding that Dr Pepper make good on its promise to give everyone in America a free soda now that Axl Rose has finished his masterpiece, 17 years in the making. IBM fights over Apple Senior VP hire of Mark PapermasterIBM has filed a lawsuit in Federal court against Mark Papermaster, a former vice president at Big Blue who quit the company in mid-October after he was offered "the opportunity of a lifetime," to head up Apple's iPhone and iPod hardware development teams. Industry Moves: WaPo Veteran Grayer Retiring As Kaplan CEOJonathan Grayer is resigning as chairman and CEO of the Washington Post Company's Kaplan Higher Education unit after 17 years in the role. His replacement is Andrew Rosen, who has served as COO since Grayer became CEO in 1992; he's been with the company since 1986. While WaPo is mainly known for publishing the Washington Post and Newsweek, it's the Kaplan unit that's been the prime revenue driver lately. I've had different bootlegs of it for the past year, and I gotta disagree. The new official release is perhaps among the best metal to be released this year (and I classify them in metal only because rock is too "lite" for them), and ranks up with Appetite. Let go of the Slash era and you'll hear it in the nasty spot on guitars and Axl's voice. Even better the lyrics are still snotty but tempered. - Cole Jolley
Sorry, can't let that 'metal' thing slip in, because it's wrong and makes the word totally meaningless. It is barely a rock album. This is an adult album, surprisingly mellow, creative, light on the in-your-face, and far from Appetite (the heavy blues-rock mode is dead and buried). The 'harder' tracks are sum'in awful. The more interesting parts of ChiDem start after track 3. Overall, it's not good enough to hoof it in to Best Buy to purchase, but if I were already there, I might put it in the basket (maybe). - Christopher Galtenberg

It’s going to cost the company a lot more to pursue the case.
