How Hasbro And Mattel Killed Interest In Online Scrabble — We've been chronicling just how badly both Hasbro and Mattel screwed up in responding to the massive success of Scrabulous on Facebook. The ridiculously popular application was attracting over 500,000 users every day and (amazingly) making Scrabble cool again, pumping up sales of the physical board game. But, of course, the intellectual property lawyers freaked out and said "this must stop." The resulting legal threats and lawsuits created quite a lot of backlash and anger (and a boycott of Hasbro games). 2007 person-to-person music downloads were worth a staggering $69 billion, and movie/television piracy continues to grow, says a new study. And all that free promotion didn’t cost them a penny. At least, that’s how Techdirt sees it. And I agree. Instead of embracing what might be the largest free marketing giveaway in the history of the world, the music labels instead sue their customers. Music Industry Squanders $69 Billion Worth Of Free Promotions In 2007 — Over the years, we've seen so many bogus reports on the supposed "losses" to various industries due to unauthorized file sharing, that it's about time the story was flipped. Broadcast.com billionaire and trailblazer for online video Mark Cuban wrote Saturday in his the best impression of Andrew Keen that internet video was ideal for snacking, but for the big events, people turn to broadcast television and HD. Cuban argues that “the platform is the message” and that HD television is where the game is at. The problem with his argument is that he mixes the delivery method with the end result. He makes the presumption that we need broadcast television to obtain the end result of quality programming, but he’s wrong. There’s 105 million reasons today why he’s wrong....

The value in (weak) copyright and patent law...for someDown in the Slashdot commentary on an excellent New Yorker article called "The Permission Problem" was this interesting comment, one that resonates with me. The idea in the New Yorker article is that intellectual property (IP) law perhaps creates more inefficiencies than it resolves by making it too expensive to bother creating around existing IP and by making it apparently too expensive to round up IP owners to get the proper permissions. Against this argument was "Shados'" suggestion that what people really want is weak IP, not no IP: Give your songs for free! The money is on the tour......

Some artists, bands and labels claim that their lives are ruined by their material being available on P2P networks. BuckCherry are complaining that a track from their latest album has leaked to BitTorrent. How do they complain? Via an Atlantic Records press release. I smell a rather large free-publicity rat.
